Our Appellate Team handles direct appeals and post-conviction matters for SCPD clients after trial. We review every trial record for legal error, litigate appeals in the Tennessee Court of Criminal Appeals and the Tennessee Supreme Court, and pursue relief in the United States Supreme Court when warranted. A guilty verdict is not the end of the road.

What We Do

Appeal is a critical part of the criminal justice process — and one that many people don’t know they have a right to. After a conviction, clients have the right to a direct appeal challenging legal errors made at trial. Our appellate attorneys review the trial record, identify issues, and litigate those issues through the state court system.

Direct Appeal

A direct appeal challenges specific legal errors in the trial — improper jury instructions, wrongly admitted evidence, insufficient evidence to support the verdict, and other issues. Appeals are filed in the Tennessee Court of Criminal Appeals, which reviews the record and issues a written decision. Further review is available in the Tennessee Supreme Court and, in some cases, the U.S. Supreme Court.

One of the most disorienting things about the criminal justice system can be getting a new attorney from a new office when a case moves from the trial to the appellate stage. But we stay with you through any appeal — you have access to your trial record, your history with us, and attorneys who understand your case.

How do I request an appeal?

Tell your trial attorney you want to appeal. After sentencing, there are strict deadlines — typically 30 days — to file a notice of appeal. Do not wait. If your trial has ended and you want to appeal, call (901) 222-2800 immediately.

It depends entirely on the specific legal issues in your case. We evaluate every record carefully and pursue every issue that has merit.
